End User License Agreement (EULA)

This End User License Agreement (“Agreement”) is a legal contract between you (“User”) and Four Winds Group, Inc. (“Company” or “We”) regarding the use of our software and services. By accessing or using our software, you agree to abide by the terms outlined in this Agreement. You may not use the software if you do not agree to these terms.

1. License Grant

Four Winds Group, Inc. grants the User a non-exclusive, non-transferable, limited license to access and use the software as a Software-as-a-Service (SaaS) solution. This license is subject to compliance with the terms of this Agreement and any applicable subscription terms.

2. Subscription & Access

Users must maintain an active subscription to access the software. Subscriptions are managed through account settings or by contacting support at hammt@fwginc.com. The Company reserves the right to modify, suspend, or terminate access at its discretion.

3. Restrictions on Use

Users may not:
– Reverse-engineer, modify or distribute the software.
– Sell, lease, sublicense, or transfer access to the software.
– Use the software for any unlawful or unauthorized purposes.
– Share login credentials or allow unauthorized users to access the software.

4. Ownership & Intellectual Property

The software and all related materials remain the exclusive property of Four Winds Group, Inc. Users receive no ownership rights in the software and may only use it under the granted license terms.

5. Privacy & Data Collection

Users acknowledge and agree to the Company’s Privacy Policy by using the software, which details data collection, processing, and storage practices. The Privacy Policy is available at [Insert Link to Privacy Policy].

6. Termination & Suspension

The Company may suspend or terminate access to the software for violations of this Agreement or any other reason deemed necessary. Users may cancel their subscriptions anytime, but no refunds will be provided.

7. Limitation of Liability

The software is provided ‘as is’ without warranties of any kind. Four Winds Group, Inc. is not liable for any indirect, incidental, or consequential damages arising from using the software.

8. Governing Law & Dispute Resolution

The laws of the State of California govern this Agreement. Any disputes shall be resolved through arbitration or mediation as per California law.

9. Changes to Agreement

Four Winds Group, Inc. reserves the right to modify this Agreement anytime. Users will be notified of changes via email or website updates. Continued use of the software constitutes acceptance of the revised terms.
